Definitions
As you read these terms and conditions, please note that:
“We”, “our”, “ourselves” and “us” means Coastal Sea School
“You”, “your” and “yourself” means the person whose name appears on the booking form and signs such form to confirm agreement of these terms and conditions.
‘Course’ means the tuition and associated facilities provided by us to teach you.
“Vessel” means any description of watercraft used or capable of being used for transportation on water.
“RYA” means the Royal Yachting Association, the governing body in the United Kingdom.
Evidence of Contract
Contract. This document, together with the information provided to you in brochures and associated literature, forms a contract between you and Coastal Sea School.
UK & Overseas courses. This document includes terms and conditions for UK & overseas courses.
Payment
No formal booking exists until we have received full payment by cleared funds, a signed completed application form and medical declaration for each person booking a course.
Deposits
A deposit of 50% of the total course fee is required to reserve your place on a course.
All courses must be fully paid for at least 28 days prior to the course start date.
Legal Obligations
You are solely responsible for complying with all laws, regulations, orders, demands and requirements of the countries where the course is conducted. We shall not be liable in any way whatsoever to you in connection with obtaining necessary documents or complying with such laws, regulations, orders, demands, requirements or instructions, whether given orally or in writing or otherwise, or for the consequences to you resulting from your failure to obtain such documents or to comply with such laws, regulations, orders, demands, requirements or instructions.
Travel documents
You are responsible for obtaining and must possess and have available for presentation as required all entry and exit, health and other documents required by laws, regulations, order, demands or requirements of any countries visited during the course. We reserve the right to refuse to provide a course to anyone who has not complied with, or whose documents do not appear to comply with, such applicable laws, regulations, orders, demands or requirements.
Conduct ashore and aboard vessels
You agree to abide by the orders and reasonable instructions of our instructors and management at all times. If in our opinion you conduct yourself aboard one of our vessels or at one of our establishments so as to endanger the vessel or any person or property on board, or behave in a disorderly manner or in a manner to which other clients may reasonably object, or behave in a manner which may jeopardise the good running of the course, or conduct yourself such that legal proceedings become necessary, or your conduct engages law enforcement officers, we may take such measures as we deem necessary to prevent continuation of such conduct including your removal from the vessel and or from our courses and properties. You may be prosecuted for offences committed on board a vessel. In this case all fees will be forfeit and we will disengage any obligations to you.
Achieving a pass on the course
You will be assessed by an Instructor and/or Examiner during the course. At the end of the course they will decide if you have passed or not. Their decision is final. If, however, you disagree with their decision you may make an application to the Royal Yachting Association for redress in the form required by that organisation.
Changes to your course
Once booked, you are not entitled to change the date and/or type of a course. We will, however, make best efforts to accommodate changes for you, if practical and without loss to us.
Cancellation by you.
The cancellation must be made in writing and a receipt given by us acknowledging the cancellation.
If you cancel your course and give less than 14 days notice a cancellation fee of the full amount of the course will be made.
If you cancel your course and give more than 14 days but less than 28 days notice a cancellation fee of half of the full amount of the course will be made.
If you cancel your course and give more than 28 days notice a cancellation fee of a quarter of the full amount of the course will be made.
Cancellation or alteration of the course by us.
We reserve the right to cancel a course at any time where numbers fail to reach a workable minimum or due to weather or any other circumstances, in which case a full refund will be made for the course fees paid only.
We will always make best efforts to provide courses as published. However, in circumstances of bad weather, operational difficulties, technical failure, local strikes, industrial actions, unplanned public holidays or staff illness, we reserve the right to make changes to the type of vessel, Instructor and schedule of a course. We will always endeavour to provide a service of equal quality.
What is included
Fees for non residential courses include: light refreshments, instruction, equipment, essential logbooks, course notes, certificates, and essential protective equipment as appropriate to the course.
Fees for residential courses include accommodation, breakfast, lunch, planned refreshments, instruction, equipment, essential log books, course notes, certificates, and essential protective equipment as appropriate to the course. Evening meals aboard are not included unless specifically booked.
Fees for courses afloat include accommodation on the vessel, instruction, equipment, essential log books, course notes, certificates, loan of waterproofs by arrangement (for a fee) and lifejacket as appropriate to the course. Evening meals are sourced & provided by you as part of the course, assistance & advice will be given upon joining the vessel.
Safety management
We hereby make you aware that activities on the water are potentially dangerous activities and we cannot be held responsible for any loss, injury or death during one of our courses.
We and our representatives have complete discretion over the management and operation of all water-
Disclosure
It is of paramount importance, for your safety and the well being of other course members that the skipper/course manager is aware of any medical or physical condition that could have a bearing on your ability to carry out the requirements of the course. It is a condition of your acceptance on the course that you complete and sign a full medical disclosure with no omissions.
You agree to protect and respect our intellectual property and not make copies unless properly authorised by our management.
Age
With the exception of those courses offered specifically for children, we will only accept students under the age of 18 at our discretion. Acceptance will depend on the requirements of the course, nature of the activity and the opportunity to provide acceptable levels of supervision. We reserve the right to require children to be supervised by a responsible adult, parent or guardian.
Water confidence
Students attending courses afloat must be either competent swimmers or water confident. Appropriate lifejackets or buoyancy aids must be worn as directed by the Coastal Sea School when on or near the water.
Personal effects
Although all possible measures are taken to ensure security the Coastal Sea School, its servants, its employees or agents are not under any liability whatsoever in respect of loss or damage to students property or belongings while attending a course.
Exclusions
The Coastal Sea School takes no responsibility for any consequential losses incurred as a result of course cancellation, change of program, vessel, accommodation or other change in advertised conditions.
Registration fees for governing bodies are not included.
Examination fees are not included in course fees unless specifically mentioned.
Course fees do not include the cost of travel to and from our courses.
Insurance
We strongly recommend that you are properly insured for your course.
It is your responsibility to ensure that your policy includes cover for cancellation, emergencies and the activities including watersports activities in which you will be participating and that you have accident and or travel insurance as you require which will cover any medical expenses and repatriation if necessary, and that this insurance covers you while at sea. You are advised to take out your own personal insurance cover to cover your requirements.
Satisfaction
We make the utmost effort to ensure our service and tuition is to a high quality. However if you become dissatisfied in any way you are obliged to inform the Coastal Sea School instructor or management at the earliest opportunity to enable us to address the error before the end of the course. We take the quality of our service seriously and will do what we can to remedy the situation. If you are still unsatisfied you should make a written complaint to our Principal.
The Company cannot accept liability for causes of dissatisfaction that are not notified to us, in writing, within 28 days of completion of the course/activity.
Force Majeure
We cannot be responsible for matters outside our control. These include (but are not limited to) adverse weather conditions, forecast adverse weather conditions including floods, storms, heavy sea state, strong winds or unforeseen circumstances, including technical problems, mechanical failure, shortage of water, non-
Mechanical & Technical Performance
We undertake regular checks of the vessels in accordance with the manufacturers and RYA recommendations. In the event of a boat suffering mechanical breakdown the Coastal Sea School shall take all reasonable steps to enable the completion of the Course with a similar vessel if available.
Media & Marketing
From time to time we or other authorised parties may carry out photography and/or video recording. You agree that we may use these images in advertising, promotional or publicity material in any format whatsoever. You further agree that copyright rests with us.
Privacy Policy
We do not pass personal details to other organisations except to government agencies when instructed, owners and skippers of other vessels that we charter, our instructors and servants for safety and practical purposes. We properly safeguard these details and keep them no longer than needed.
Termination of booking
We reserve the right in our absolute discretion to terminate without further notice the booking arrangements of any client who refuses to comply with the instructions or orders of the Company staff or other responsible person whose behaviour in their opinion is likely to cause distress, damage, danger or annoyance to other clients, staff, any third party or to property. Upon such termination our responsibility for your booking ceases and we shall not be liable for any extra costs incurred by you.
Consent
By submitting an application you are consenting to be bound by these terms and conditions.
Any litigation referring to the contract will be dealt with according to English law in an English court unless required where reasonable and legal grounds exist
Adjustment of Terms and Conditions
The Coastal Sea School reserves the right to:
a) Alter prices where necessary, giving 28 days notice
b) Cancel a course for any reason up to 2 weeks before it is due to start.
c) Decline a booking for reasons of safety, experience or other reasonable cause.
d) Request a student to withdraw from a course.
e) Change the advertised craft, programme or accommodation
f) Allocate rooms and accommodation as circumstances dictate.
Coastal Sea School reserves the right to amend these Conditions of Booking without notice and will post such amended terms and conditions on our website.
